Your article is succinct. There is no doubt about the use of Judicial Notice. It's too bad that so many Canadians don't understand the divisions within our parliamentary system and how they are supposed to work and thus they believe that judges must be right no matter what. I wish you had gotten into the Coutts 4 a little deeper. Their case is a complete miscarriage of justice and another example of how the upper echelon of the RCMP ensures their members carry out the wishes of the government, rather than protecting the citizens. This is very good, Tom. Much confusion in the extreme polarization of views between the left and right is due to a lack of understanding and respect in distinguishing the heterogeneity of these two domains—being the church and the state. From my first book on… “Faith and reason unified….” I draw this needful distinction. On the other hand… the state is the state. The church is the church. And the people are the people—as individuals that are both sovereign as well as in relation with the other. And these are the three life forces in which the checks and balances are to be maintained. It is when the sovereignty of the church-(I am speaking distinctly of the early church here) is put in question and individual sovereignty is no longer upheld that the state needed to create its own set of checks and balances within rather than it being maintained without. If that makes sense to you. And yes, absolutely it should have its own source of internal accountability but not as a means to replace or override the pre-existing external checks and balances.
